Jack Schaap may be facing up to 10 years in prison

Jack Schaap of First Baptist Hammond Facing 10 Years in Prison for Teen Affair

“I have agreed, as set forth in a separate filing with the Court, to wave my right to Indictment by a federal Grand Jury with respect to the charge of transporting a minor with intent to engage in criminal sexual activity and to plead guilty to that charge,” reads Schaap’s plea agreement in court documents obtained by The Christian Post. The court document also states that the expected sentence for such a crime could be up to 120 months, or 10 years incarceration.

Discussion

According to Jim’s post above:

The charge comes with a mandatory minimum sentence of 10 years,

Is he likely to get the maximum since this is a first offense (I would think of any kind).

An attorney and former prosecutor opined this (message to me): “My guess is 5/5 which w/be 5 jail time 5 probation plus a fine plus register as a sex offender”

I’m not sure if the Feds do probation anymore.

Hoping to shed more light than heat..

very glad to see him accept responsibility and accept the courts verdict, whatever that may be.

Jack Hyles insisted he had not done anything wrong because no one had SEEN him do anything wrong.

sad though for his wife who had a father, a brother, and now a husband, that were all lacking in their sexual morals.

Some of you will remember the “100% Hyles” buttons that were sent to pastors all over the country back when the Hyles Scandal broke… My pastor was sent one and refused to wear it (thankgoodness). The guy who created those buttons along with Voyle Glover, author of Fundamental Seduction is interviewed on this blog radio show. Quite interesting.

I am listening to this right now. Thanks for bringing this to our attention. I posted this as a filing.

Plea bargains are often more about minimizing consequences than anything else, at least on the part of the defendant. We shall if any fruit of real repentance is demonstrated in the weeks, months, years ahead.

Ten years in the slammer is pretty serious time, especially at his age. That’s the minimum, if the judge gives him much more it will be virtually a life sentence.

He isn’t fighting the charges, isn’t forcing the girl to give evidence in court, isn’t dragging the system through a lot of needless cost. He is admitting guilt.

I’m not a fan, but these steps are the right thing to do in the circumstances.

Well, I suppose they might be right steps, but they seem to me incomplete especially since he is avoiding prosecution on other charges by taking this. Looks to me like his lawyer told him that, based on the case the feds had, that 10+ was the best he could get and he should take it.

But as far as “the right steps” shouldn’t he also:

-confess his wrongdoing to the girl and her parents and seek their forgiveness and make whatever amends are makeable?

-do the same re: any other victims there may be?

-confess his predation and other abuses of his office to his former congregation, seek their forgiveness, and make amends, etc?

And about admitting guilt: There were pictures. Emails. Witnesses. No one should be either surprised or pleased he decides he has something to confess.

EDIT: I guess my point is that it’s fine to be hopeful that God is working repentance in Schaap. It may well be. But I do not think we have seen anything yet that would so indictate. Too early to tell.
