Will Christian Colleges Lose Their Tax Exemption After Obergefell?
The article makes good points, but is mistaken on the usefulness of the Religious Freedom Restoration Act to avoid the potential impact of the IRS v. BJU case. It’s true that RFRA was adopted after the BJU case, but all RFRA did was restore the compelling state interest test as the limitation on restrictions of free exercise rights. The Employment Division v. Smith case in which the compelling state interest test was jettisoned by the Supreme Court (in an opinion by Justice Scalia!) also came after the BJU case. So the same defenses that RFRA makes available to religionists today were available to BJU under the Supreme Court’s pre-Smith precedent. In other words, RFRA did not change the law applied in the BJU case; RFRA merely ensured that the law applicable at the time of the BJU case is still applicable today. That law didn’t help BJU, so I wouldn’t expect it to help Christian colleges today.
I am not as optimistic as this author. I personally know several LGBT activists who are faculty members at my university. They are aggressive, active, and total bulldogs. They aren’t quitting until every “Christian” is thoroughly and utterly defeated.What’s more, most 20-30 year olds agree with them, at least in the principle that LGBT is A-OK. If full-blown LGBT rights were put up to a vote today I think they would win many states. And we know from the USSC that if one state agrees that something is a right, in short order it applies to the whole union.
I think within 5 years churches will start to lose 501c3 status, and local sales tax exemption. It could be faster than that… Also, I think in 5 years LGBT/sexual identity, etc, will be added to the Civil Rights Act. Then dominoes will fall in short order.
Another thing, America is NOT Canada. No offense to Don Johnson, but American evangelicals and fundamentalists are more rabid that our Canadian brothers (in general), and our “progressive” foes are more rabid as well.
Christians will go to jail, be fired, publicly shamed…
Unless something dramatic happens. We should pray to God and ask for America to be delivered in a revival. We need to preach like never before, and witness like never before.
