I tend to trust NR more than FoxNews on these things, but it is worth noting that one possible big reason for remanding this to the lower courts is because the lower courts in Oregon specifically ignored one of the big issues in the Colorado decision; the 1st Amendment and hostility to religion. We should watch this carefully, because if it goes the wrong way, it’s a significant infringement on the 1st Amendment guarantee of religious liberty.
